- Goods sold and invoiced by Kent & Sussex Pool Care/Construction remain the property of the company until paid in full.
- If payment is not made within an agreed time, the goods will be repossessed and removed from the customer’s premises at the customer’s expense.
- All invoices must be paid in full within 14 days of invoice unless otherwise prior agreed. Interest at the rate of 2% will be charged per week. Any queries on an invoice must be raised in writing within 7 days of the invoice date.
- All quotations must be accepted in writing.
- If a quotation is agreed/accepted and then cancelled by the customer, a 10% charge will be levied, in the form of an account, on the complete quotation.
- All quotations stand for a period of 90 days from quotation date, unless otherwise stated. All work accepted in this time must commence within 3 months of quotation date, unless otherwise stated by the company.
- Staggered payments will be stipulated on individual quotations. If these are not adhered to the company reserves the right to withdraw from site.
- Any additional work requested by the customer after the original quotation is accepted will be quoted for separately and agreed upon before further work commences.
- Quotations for remedial pool works, repairing or fitting new liners or carrying out repairs, are calculated on a surface inspection only and any extra works found necessary which were unknown or hidden before work commenced, shall be charged accordingly, after prior consultation with the customer. All such variations to be in writing.
- The customer affirms that they own the land or premises in which the pool is to be constructed.
- When emptying pools, while exercising the upmost care, external pressures can cause damage to the pool construction and unforeseen delays in liner shrinkage. Kent & Sussex Pool Care/Construction cannot accept liability if this occurs. All such risks are the customer’s responsibility.
- If other works are being carried out by the customer or other persons in the vicinity of Kent & Sussex Pool Care/Construction works and such works hold up completion of Kent & Sussex Pool Care/Construction contract, the completion date will be adjusted accordingly. Full payment for the work completed and any materials or equipment on site shall be due for payment.
- Kent & Sussex Pool Care/Construction shall make every effort to carry out the work in a neat and efficient manner and leave the site tidy, but this agreement does not cover reinstatement of lawns, trees, shrubs, driveways, paths, paving etc., damaged during installation or access to site.
- Any underground services that require re-routing will be dealt with at an extra cost to the customer. In extreme cases, it may be necessary to alter the location, specification or elevation and a cost adjustment may be necessary to the original quotation.
- The customer agrees to provide the electricity and water required for the Contract.
- After handing over of the works carried out, the customer shall be responsible for the insurance, care and maintenance of the pool and equipment. Maintenance service packages can be arranged with Kent & Sussex Pool Care.
- The company reserves the right to increase the Contract price of any of its goods in line with any increase in price of materials between the date of the company’s quotation and the date of the completion of work.
- Orders are accepted and promises of delivery and commencement given conditionally on Kent & Sussex Pool Care/Construction being able to secure the required labour and/or material and without responsibility for delays arising from uncertainties of manufacture, strikes, accidents, or exceptionally inclement weather or other causes beyond the control of Kent & Sussex Pool Care/Construction.
- If any goods received are damaged or deficient in quantity, it is essential that we are notified in writing within 48 hours of receipt of in the event of non delivery, within 10 days of dispatch.
- Claims for transit damage or shortage cannot be entertained unless advised within 48 hours of receipt. To protect themselves customers should also report any damage, etc., to Carriers at destination, as carriers will not recognise claims unless notified within 3 days after delivery.
- A guarantee of 10 years is given on the concrete pool structure of a new swimming pool tank. Marbelite, mosaic, coping and paving carry a 2 year guarantee. Staining of the above items by leaves, impurities in any water going in to the pool, or un-dissolved chemicals thrown directly in to the pool is not covered by the 2 year guarantee. All other equipment carries a manufacturing guarantee ranging from 1-3 years, depending on the type of equipment.
- All guarantees are not covered by the following:- frost damage, damage to equipment and pool lining caused by incorrect PH, bad pool chemistry, un-dissolved chemicals thrown directly into the pool or if the pool is emptied without prior consultation with the contractor. These guarantees are not transferable and exclude consequential losses of any kind whatsoever.
- Kent & Sussex Pool Care/Construction reserve the right to alter prices without prior notice.
- Placing an order with Kent & Sussex Pool Care/Construction means acceptance of these terms and conditions.
